These Terms and Conditions ("Terms") apply to all services provided by Phuengpha Legal ("we," "us," or "our") to clients ("you") at our practice located at 128 Lat Phrao Road, Chatuchak, Bangkok 10900, Thailand. By engaging our services, you acknowledge that you have read and understood these Terms.
1. Scope of Services
Phuengpha Legal offers family legal services in Thailand, including initial consultations, parenting and support arrangement guidance, and cooperative agreement drafting. The precise scope of work for your matter will be agreed upon in a separate engagement letter or service agreement before any substantive work begins.
Our services are provided for informational and assistance purposes within the boundaries of Thai law. They do not constitute a substitute for independent legal advice from a qualified Thai advocate where your situation requires court representation.
2. Engagement & Retainer
A formal engagement begins only when both parties have agreed on the scope of services and you have provided the information or documentation reasonably requested. We reserve the right to decline or discontinue an engagement if a conflict of interest arises or if the matter falls outside the scope of our practice.
Service fees are as described at the time of engagement. Fees listed on our website or materials are indicative and may be adjusted based on the complexity of your circumstances, with prior notice to you.
3. Client Responsibilities
- Provide accurate, complete, and timely information relevant to your matter.
- Notify us promptly if your circumstances change in a way that may affect the advice or services provided.
- Communicate in a respectful manner with our team.
- Review and respond to documents and correspondence within reasonable timeframes to allow your matter to proceed smoothly.
4. Confidentiality
All information you share with Phuengpha Legal in connection with your matter is treated as strictly confidential. We will not disclose your personal or case information to any third party without your express consent, except where required by Thai law or a binding court order.
Please note that confidentiality applies to information exchanged within a formal engagement. Inquiries made before a formal engagement is confirmed will be handled with discretion but may not carry full legal privilege in all circumstances.
5. Fees & Payment
Our fees are quoted in Thai Baht (฿). Payment terms will be stated in your engagement letter. We may request a deposit before commencing substantive work. Invoices are generally payable within 7 days of issuance unless otherwise agreed.
If a matter requires additional work beyond the original scope, we will discuss the additional fees with you before proceeding. We aim to be transparent about costs throughout your engagement.
6. Cancellation & Rescheduling
You may cancel or reschedule a consultation by contacting us at least 24 hours in advance. Cancellations with less than 24 hours' notice may result in the consultation fee being retained to cover the reserved time. We will make reasonable efforts to accommodate rescheduling requests.
7. Limitation of Liability
Our services are provided with reasonable care and skill. However, outcomes in family legal matters depend on many factors outside our control, including the conduct of other parties, court decisions, and changes in law. We do not accept liability for outcomes that result from inaccurate or incomplete information provided by you, or from circumstances beyond our reasonable control.
Our aggregate liability to you in connection with any single matter shall not exceed the total fees paid by you for that matter.
8. Intellectual Property
All documents, written summaries, and other materials prepared by Phuengpha Legal for your matter are provided for your personal use. You may not reproduce or distribute those materials for any commercial purpose without our prior written consent. Ownership of original documents remains with the respective parties as applicable under Thai law.
9. Governing Law
These Terms are governed by and construed in accordance with the laws of the Kingdom of Thailand. Any disputes arising from or in connection with these Terms shall be subject to the jurisdiction of the courts of Bangkok, Thailand.
10. Changes to These Terms
We may update these Terms from time to time to reflect changes in our practices or in Thai law. The revised Terms will be posted on this page with an updated date. Your continued engagement with our services after any revision constitutes acceptance of the updated Terms.
